The UNC football player accused of sexually assaulting a fellow student has a court date set for Sept. 29.
UNC linebacker Allen Artis has been charged with two misdemeanors 鈥� assault on a female and sexual battery 鈭� but not felony rape. The UNC Department of Public Safety officers investigating the case say there is not enough evidence to get the felony conviction.
The alleged victim, UNC sophomore Delaney Robinson, came forward to campus police in February on the night she says Artis raped her in a campus dorm. She allowed a rape kit to be taken at UNC Hospitals, and had pictures taken of bruises to her neck and body.
Robinson , and should have passed the case on to the Chapel Hill Police Department, which has a sexual assault specialist.
Orange County District Attorney Jim Woodall says officers are still gathering evidence.
In lieu of rape felony charges, Robinson went to a magistrate and self-swore a warrant to have her alleged assailant arrested on the two misdemeanors. The magistrate signed the warrant, saying there is probable cause to believe Artis assaulted Robinson and had sex with Robinson against her will.
Artis appeared before the magistrate Wednesday morning and was released on a $5,000 unsecured bond.
Artis' attorney Sam Coleman appeared in court Wednesday afternoon. He could not be reached for comment.
